29 CFR 1926.404(b)(1)(ii): On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure and which are in use by employees did not have approved ground fault circuit interrupers for personal protection: a) On or about 9/21/2018, in the atrium area: A CAP C59960 paint sprayer was energized through an extension cord which was plugged into a floor outlet. No GFCI protection was in use. Abatement certification is required for this item.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access: a) On or about 9/21/2018, in the atrium area: Safe means of egress was not provided to all levels of the scaffold being used by employees who were painting. A built in ladder between two working levels of supported scaffolding did not extend to the upper level, was over 1.5 feet horizontally from the upper level, and there was no opening in the rail system. Employees were traversing between levels by climbing exterior bracing. Employees were exposed to falls of over 29 feet. Abatement documentation is required for this item.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about 9/21/2018, in the atrium area: Employees walking and working on the first floor center crossover were exposed to two 68 inch wide unguarded wall openings located on the North side of the crossover. Employees exposed to falls of approximately 17 feet. b) On or about 9/21/2018, in the atrium area: Employees walking and working on the second floor, West side, were exposed to unguarded floor openings. Employees were exposed to falls to the first floor elevation and to the basement elevation. Employees were exposed to falls of up to 32 feet. c) On or about 9/21/2018, in the atrium area: Employees walking and working on the second floor at the North West corner material staging area were exposed to falls of 32 feet to the basement. Abatement documentation is required for these items.
