29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, or uprights did not bear on base plates, mud sills or other adequate firm foundation: Employees were exposed to fall hazards. Employees installing a down spout at the construction site located at 101 North Kansas in Topeka, Kansas were exposed to fall hazards while working from a double wide nine tier high scaffolding in that the mud sills supporting the base plates were not positioned upon a firm foundation. a) The base plate on the northwest corner of the six point side-by-side scaffolding array over hung the mud sill. b) The base plate on the central east leg mud sill of the six point side-by-side scaffolding array was placed on unstable footing.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Employees were exposed to fall hazards. Employees installing a down spout at the construction site located at 101 North Kansas in Topeka, Kansas were exposed to fall hazards while climbing on the outside frame work of a double wide nine tier high scaffolding without using the available ladder.
