OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that could cause death or serious physical harm to employees in that an employee was exposed to crushing hazards while operating a Sunbelt rental JLG SkyTrak Telehandler Fork Truck, Model #10054 without restraint systems: On or about 09-25-2018 and times prior thereto, located at Newport News Shipbuilding, 4101 Washington Ave. at 50th Street Newport News, VA. under the Goliath Crane, an employee who operated a Sunbelt rental JLG SkyTrak Telehandler Fork Truck, Model #10054 was not using a seat belt restraint. This condition was observed on or about September 25th, 2018. Abatement documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employee(s) and their representatives were informed of this abatement.

29 CFR 1910.178(l)(3)(i)(A): Powered industrial truck operators did not receive training on operating instructions, warnings, and precautions for the types of truck the operator was authorized to operate: On or about 09-25-2018 and times prior thereto, located at Newport News Shipbuilding, 4101 Washington Ave. at 50th Street Newport News, VA, under the Goliath Crane, an employee operated a Class 7 Rough Terrain (solid tire) Sunbelt rental JLG SkyTrak Telehandler Fork Truck, Model #10054 without receiving training specific to that class. This condition was observed on or about September 25th, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employee(s) and their representatives were informed of this abatement.
