OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by articles that could roll.      On or about September 26, 2018, and at times prior thereto, at the facility, where trailer tie downs securing loaded steel pipe were released from steel pipe, and a steel pipe rolled from the trailer.    Among other methods, feasible and acceptable means of abatement would include:  Articles of cargo that are likely to roll, such as steel pipe, will be restrained by chocks, wedges, a cradle or other equivalent means to prevent rolling.  The means to prevent rolling must not be capable of becoming unintentionally unfastened or loose while in transit.  The employer will insure the securement of articles of cargo that are likely to roll is inspected prior to the release of any tiedowns, and prior to unloading, to ensure the chocks, wedges, cradle or other equivalent means have not become unfastened, broken, or loose, and the articles of cargo which might roll remain stable and secure.  The employer will ensure stanchions of sufficient height to retain all articles of cargo that could roll, such as steel pipe, are provided and used on flatbed trailers used to transport this type of cargo.  The employer will implement a written policy establishing the safest method to remove restraint devices, including tie down devices, from articles of cargo which could roll during unloading.  The employer will ensure all affected employees are trained on this procedure.  When feasible, articles of cargo that could roll will be engaged by material handling equipment prior to releasing load securement devices.

29 CFR 1926.602(d): Training did not consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace as required by paragraph 29 CFR 1910.178(l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d).    On or about September 26, 2018, and at times prior thereto, employees throughout the facility were required to operate a forklift without successfully completing formal and practical operator training.
