29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):    (a) On or about September 21, 2018, and at times prior, Summerfield Construction, Inc. as the controlling, creating, and exposing employer, did not initiate and maintain a program which provided for frequent and regular inspections of the job site, materials and equipment to be made by competent person(s). Employees of Summerfield Construction, Inc. and employees of U Call We Haul Scrap Metal Removal, a subcontractor, were exposed to crush-by hazards while demolishing walls and load-bearing columns on a pavilion structure at 960 Hidden Valley Rd. Colorado Springs, CO 80919. A competent person did not conduct frequent and regular inspections of the job site, materials, and equipment. 29 CFR 1926.850(a): An engineering survey was not performed by a competent person to determine the conditions of the framing floors and walls and the possibility of unplanned collapse of any portion of the structure prior to permitting employees to start demolition operations:    (a) On or about September 21, 2018, and at times prior, Summerfield Construction, Inc. as the controlling, creating, and exposing employer, did not ensure that an engineering survey was performed by a competent person to determine the conditions of the framing walls and the possibility of unplanned collapse of a pavilion structure at 960 Hidden Valley Rd. Colorado Springs, CO 80919, prior to permitting employees to start demolition operations. Employees of Summerfield Construction, Inc. and employees of U Call We Haul Scrap Metal Removal, a subcontractor, were exposed to crush-by hazards while demolishing walls and load-bearing columns on the pavilion structure. The pavilion structure collapsed causing fatal injuries to a worker.       Abatement Note: Abatement certification is required for this item.
