29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:(a) (LOCATION) (IDENTIFY SPECIFIC OPERATION(S) AND/OR CONDITIONS) a) Worksite, 550 Old Country Rd., Plainview, NY 11803, south side of residence - An employee was using a WERNER portable fiberglass extension ladder Serial # E1020-2 to access the working level at approximately 18 inches above the landing surface, on or about 10/01/2018. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification of documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards. a) Worksite, 550 Old Country Rd Plainview, New York 11803, south side of residential building - Employees were utilizing a WERNER fiberglass extension ladder to access a roof that was not extended 3 feet above the landing surface. The employees had not been trained by the employer to recognize the hazards of ladders and the procedures to be followed in order to minimize these hazards, on or about 10/01/2018. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
