29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  Employee's were exposed to struck by hazards from forklifts. Forklift operators were not trained with training consisting of formal instruction, and practical training and evaluation. There was no written and practical evaluation of the forklift operator's driving.

There was no forklift written operator training certification included the name of the operator, date of training, and identity of the person(s) giving the training or evaluation.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):  a) Employees were exposed to struck by hazards as the Doosan 45 Propane forklift had a brake pedal without a nonskid cover and the backup alarm was not working.  The Doosan forklift had not been taken out of service until it was in safe operating condition.   b) Employees were exposed to struck by hazards as the Doosan Diesel forklift Driver's left light was not working.  The Doosan forklift had not been taken out of service until it was in safe operating condition.  c)  Employees were exposed to struck by hazards as the Nissan Diesel forklift, the front lights were not working.  The Nissan MWG forklift was not taken out of service until it was in safe operating condition.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  Employees are exposed to chemical hazards.  There was no written hazard communication program when employees are exposed to propane and diesel.  There was no written hazard communication to explain how chemicals would be labelled, how safety data sheets would be maintained, and training given.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  Employees are exposed to chemical hazards.  Employees were not trained on the hazards of chemicals when they are exposed to propane and diesel fuel.  Both propane and diesel fuel are flammable chemicals.
