The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e): a) Vicinity of True Value Hardware, 200 Tuckerton Rd: Employees were working from a JLG Model 400S aerial lift either without any fall protection or using fall protection improperly while installing siding on the front of the dormers approximately 13 feet above ground, on or about 10/01/2018. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
