29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. On or about 13 September 2018, the employer failed to notify the local OSHA Office within twenty-four (24) hours after the in-patient hospitalization of an employee. The employee suffered a head injury while at work and was hospitalized as a result. Abatement documentation is not required for this item. The Bloomin' Brands, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1904.39(a)(2), which was contained in OSHA inspection number1297926, citation number 1, item number 1 and was affirmed as a final order on 08/30/2018, with respect to a workplace located at 11196 Abercorn Street, Savannah, GA. 31419.
