29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    (a) A written Energy Control Program (Lockout/Tagout) was not developed, implemented and utilized to ensure employee(s) who perform maintenance, repair and machine set-up on, but not limited to the Marvel Horizontal band saws, Modern Pipe Cutting machine, pipe bender laser cutting machines, pipe benders, 5 Ton powered bridge crane and air compressor, were not exposed to unexpected energizing, startup or release of stored energy from mechanical equipment.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a) Modern Pipe cutting machine: Employees who worked on or around the Modern Pipe cutting machine were not protected from the multiple in-going nip points and moving parts, exposing employees to caught-in, struck by and crushing hazards.    (b) Modern Pipe cutting machine: The employer did not insure guarding was utilized on cell safety system to prevent employees from entering enclosure during machine cycle, in-that the interlock was bypassed. This exposed employee(s) working on or around the pipe cutting cell to struck by hazard, crushing hazard and amputation injury.

(a) Modern tube cutting machine: Part conveyor 40 chain and drive sprockets located approximately four (4) feet above the ground were not enclosed, exposing employees to caught in and caught between hazards.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:     (a) A written hazard communication program was not developed and implemented by the employer to inform employees of the chemical hazards they are potentially exposed to while manufacturing steel tube products. The program is to cover at least the following information:    1) A description of labeling information on received containers, which are required to be labeled in accordance with Haz Com 2012, including product identity, pictogram(s), hazard statement, signal word, and precautionary statement(s);    2) A description of any  in-house labeling system used to convey  required workplace label information;    3) Safety Data Sheet (SDS) availability;    4) A description of how training will be provided regarding the hazards of the chemicals in the work area to each new worker prior to being exposed to hazardous chemicals, and prior to introducing a new chemical hazard into the work area;    5) A complete list of hazardous chemicals known to be in the workplace;    6) Methods to inform employees of the hazards of non-routine tasks;    7) Methods to inform other employer(s) of  safety data sheet availability, the labeling system, and any precautionary measures necessary to protect employees.    This exposed employees to flammable and irritant chemicals, such as but not limited to solvents, metal working coolants, and lubricants.
