29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).    (a)Gabriel Orlando Ramirez dba Ramirez Construction at 808 North Danielle Drive, Sioux Falls, SD 57103:  On or about and at times prior to October 2, 2018, the exposing employer did not ensure employees that were working from height while engaged in roofing activities on a residential property, were protected from falls using a fall protection system. This condition exposed employees to a fall hazard of approximately 18 feet.

29 CFR 1926.502(d)(15): Anchorage points used for attachment of personal fall arrest equipment were not  independent of any anchorage point being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee.  (a)Gabriel Orlando Ramirez, dba Ramirez Construction at 808 North Danielle Drive, Sioux Falls, SD 57103:  On or about and at times prior to October 2, 2018, the exposing employer did not ensure that roof anchors installed as part of the fall protection system were installed by a competent person, in that, the roof anchorage was utilized with an insufficient number of screws in the anchor plate, which was not according to manufacturers specifications. This condition exposed employees to a 18-foot fall hazard.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a)Gabriel Orlando Ramirez dba Ramirez Construction at 808 North Danielle Drive, Sioux Falls, SD 57103:  On or about and at times prior to October 2, 2018 the exposing employer did not ensure that each employee engaged in roofing operations on a residential property, had been trained to recognize the hazards associated with working at elevations over 6'. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training prior to working at elevations over 6 feet.  The condition exposed employees to the hazard of falling from an elevation of approximately 18 feet.

(a)Gabriel Orlando Ramirez dba Ramirez Construction at 808 North Danielle Drive, Sioux Falls, SD 57103:  On or about and at times prior to October 2, 2018, the exposing employer did not ensure that the ladder that was being used to gain access to the residential roof was extended at least 3 feet above the upper surface to ensure safe operations for employees.  This condition exposed employees to a fall hazard of 10 feet.

(a)Gabriel Orlando Ramirez dba Ramirez Construction at 808 North Danielle Drive, Sioux Falls, SD 57103:  On or about and at times prior to October 2, 2018, the exposing employer did not ensure that each employee utilizing a portable ladder to access the roof of a residential property, had been trained to recognize the hazards associated with using this type of equipment. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received ladder training. The condition exposed employees to the hazard of falling from an elevation of approximately 10 feet.
