On or about October 4, 2018, at the above address, an employee was required to operate a powered industrial vehicle and had not been provided with training, including but not limited to formal instruction, practical training and an evaluation of the operators performance, thereby exposing employees to fall, struck by and crushing hazards.

29 CFR 1926.501(b)(4)(ii): Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes (including skylights) by covers:  a. On or about October 4, 2018, at the above addressed jobsite, employees conducting carpentry operations, drywall operations and painting operations on the third floor, were exposed to injuries from stepping into holes measuring nineteen (19") inches in length by twelve (12") inches width. The depth was approximately two (2) to three (3) inches in depth.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  a. On or about October 4, 2018, at the above addressed jobsite, employees performing various construction operations were exposed to falls of three (3) and four (4) stories created by the presence of wall openings.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:  a. On or about October 4, 2018 - at the above addressed jobsite, employees were lifting paint buckets using a manufactured box that was damaged on a JLG Rough Terrain Forklift Model #G12-55A TURB.  The box was heavily damaged and rigged improperly to the fork mast with electrical wire. This practice could affect the capacity and the safe operation of the equipment and the manufacturers written approval was not obtained, thereby exposing the employees to fall and struck by hazards.
