29 CFR 1910.1030(c)(2)(i): Employees were exposed to the physical hazards of acquiring bloodborne pathogens while giving injections and performing related medical procedures, without have an exposure determination prepared at the workplace. The exposure determination must contain a list of all job classifications in which all employees in those job classifications have occupational exposure, a list of job classifications in which some employees have occupational exposure, and a list of all tasks and procedures or groups of closely related task and procedures in which occupational exposure occurs and that are performed by employees in job classifications listed in accordance with the provisions of paragraph (c)(2)(i)(B) of this standard: On or about September 24, 2018, and at times prior thereto, employees were not provided with an exposure determination at the workplace, as the employer had not prepared this to address job classifications and tasks in which occupation exposure occurs.

29 CFR 1910.1030(f)(3)(ii)(A): The source individual's blood was not tested as soon as feasible and after consent was obtained in order to determine HBV and HIV infectivity. If consent was not obtained, the employer did not establish that legally required consent could not be obtained. When the source individual's consent is not required by law, the source individual's blood, if available, was not tested and the results documented: On or about September 24, 2018, an employee was exposed to physical hazards of bloodborne pathogens, while experiencing a needlestick when giving an injection, as the source individual's blood was not tested to determine HBV and HIV infectivity.
