29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a)  New townhome construction located on Lots 42-45, Upper Roof: On or about 10/05/2018, and at times prior, the employer exposed employees to falls of approximately 30-feet to the lower level, in that fall protection was not provided to employees engaged in roofing activities on a 6/12 pitched roof.   (b) New townhome construction located on Lots 42-45, Lower Roof: On or about 10/05/2018, and at times prior, the employer exposed employees to falls of approximately 12-feet, 6-inches to the lower level, in that a hole which measured approximately 24-inches by 24-inches on the roof was not covered to prevent falls to the lower level.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) New townhome construction located on Lots 42-45, Front side: On or about 10/05/2018, and at times prior, the employer exposed employees to fall hazards of up to 14-feet, 4-inches to the lower level, in that the ladder provided to access the lower roof was not extended at least 3-feet past or secured to the structure to allow for safe access on and off the roof.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:   (a) New townhome construction located on Lots 42-45, Front side: On or about 10/05/2018, and at times prior, The employer exposed employees to fall hazards of up to 14-feet, 4-inches to the lower level, in that the ladder used to access the lower roof was damaged not removed from service as the side rail was bent and the right side rung lock was missing. The employer failed to tag the ladder and remove from service prior to the start of the shift.
