29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) Roof - Employees were observed working on the uppermost level of a multi-level flat roof and were not protected from an approximate 26 foot fall hazard to the ground below, on or about October 5, 2018. b) Roof - Employees were observed working on the uppermost level of a multi-level flat roof and were not protected from an approximate 8 foot fall hazard to the lower roof surface below, on or about October 5, 2018. c) Roof - Employees were observed working on the first level of a multi-level flat roof and was not protected from an approximate 18 foot fall hazard to the ground below, on or about October 5, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided: a) Roof - On or about October 5, 2018, the employer had not installed stairs or a ladder for employees to access multiple levels of the roof area, requiring employees to climb over an approximate 2 foot high wall to gain access from the lower roof to an upper level roof. b) Roof - On or about October 5, 2018, the employer had not installed stairs or a ladder for employees to access multiple levels of the roof area, requiring employees to climb over an approximate 4 foot high wall to gain access from the lower roof to an upper level roof. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
