OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards:                                                                                                    (a) On or about October 5, 2018, and at times prior, as a controlling employer Conesco Storage Systems, Inc. did not ensure that employees working on a non-approved work platform of approximately 10 to 20 sheets of plywood, 4 feet by 8 feet, adjusting cantilever arms on a new racking system approximately 8 feet above the ground, were protected from fall hazards by using a fall protection system, in that an employee suffered a fall where he sustained severe injuries such as but not limited to broken ribs and broken vertebrae.  Reference 1. UniCarriers Operator's Manual, Page 31, Safety Rules and Practices states "Do not stand on or underneath forks. Riding on the forks is strictly prohibited. Furthermore, do not stand immediately underneath the forks. Otherwise, serious accidents can occur if the forks should move abruptly and the load placed on the forks unexpectedly falls down". Page 15 states "Do not permit riders on any part of the truck at any time. The operator is the only one who should be on a truck".  Reference 2.
