29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  On or about 10/04/2018,  Location: Excavation between new Sunshine Inn Hotel and the road located at 9121 Southern Blv., Royal Palm Beach, FL;  1) An employee working inside an excavation was exposed to struck by hazards while not protected from the dirt and rocks from a spoil pile located less than 1ft from the edge of the excavation from falling or rolling inside the excavation. No other retaining devices were observed.

29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:  On or about 10/4/2018,  Location: Excavation between new Sunshine Inn Hotel and the road located at 9121 Southern Blv., Royal Palm Beach, FL;  1) An employee was exposed to cave-in hazards while working inside an excavation which depth was 4ft to 5ft and length more than 25ft not provided with a safe mean of egress.  1st Repeat:  BCM Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(c)(2), which was contained in OSHA inspection number 1246913, citation number  1, item number 1 and was affirmed as a final order on 08/29/2017, with respect to a workplace located at 1919 Se 10th Ave Fort Lauderdale, FL 33316.
