29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) New residential construction located on Lot #1, Third floor top plate: On or about 10/09/2019, and at times prior, the employer exposed employees to falls of 30-feet, 7-inches to the lower level, in that a fall protection system was not provided to employees engaged in roof rafter installation.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:  (a) New residential construction located on Lot #1, Stairway between first and second floors: On or about 10/09/2018, and at times prior, the employer exposed employees for falls up to 5-feet, 7-inches to the lower level as a stair rail was not installed on the open side of the stairway to allow employees safe access to the upper and lower levels.

29 CFR 1926.1053(a)(2): Ladder rungs, cleats, and/or steps were not parallel, level, and uniformly spaced when the ladder was in position for use:  (a) New residential construction located on Lot #1, Ladder located between second and third floors: On or about 10/09/2018, and at times prior, the employer exposed employees to fall hazards up to 12-feet to the lower level, in that the ladder used did not have uniform space between the rungs as the rungs were not uniformly spaced and side rail fillers did not fit between cleats.
