OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to under-ride hazards: (a) Warehouse - Sufficient safe clearance did not exist in floor level storage rack slots where employees operated a Yale order selector, model OS030ECN24TE089, serial number C801N05813D, to retrieve boxes. This Yale order selector had an open operator compartment with an overhead guard 77 3/4 inches above the floor (with mast lowered), and the storage racks' first horizontal rack beam had a height of 56 inches from the floor to the bottom of the beam. This would allow the horizontal rack beam to enter the operator's compartment (an under-ride situation), pinning the operator between the beam and the order selector's mast, on or about October 5, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) Shipping and Warehouse - The employer did not provide training and evaluation on powered industrial trucks as required by the standard to employees, and the employer permitted these employees to operate the Yale sit-down rider forklifts and a Yale order selector, exposing employees to hazards including, but not limited to, tipping of the forklift and under-ride, on or about October 10, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.157(g)(2): The educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage fire-fighting was not provided to all employees upon initial employment, and at least annually thereafter: (a) San Diego Sign Company, Inc., dba WS Display, 6 Pine Hill Drive, Carlisle, Pennsylvania - The employer provided portable fire extinguishers for employees to use to fight incipient stage fires. However, the employer had not provided initial education to employees on fire extinguisher use and the hazards of incipient stage fire-fighting, exposing employees to the hazard of injurious contact with smoke or other burning/smoldering materials, on or about October 10, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
