29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about November 8, 2018, at this establishment, where employees manufactured granite and other stone countertops were exposed to noise hazards without a continuing, effective hearing conservation program in place: a. The Polisher Operator was exposed to a noise level of 99.04 dBA during a 437 minutes sampling period; b. The Cutting Granite Machine Operator was exposed to a noise level of 90.62 dBA during a 414 minutes sampling period; c. The Cutting Edging Machine Operator was exposed to a noise level of 85.59 dBA during a 416 minutes sampling period; and, d. The Granite Fabricator was exposed to a noise level of 92.13 dBA during a 421 minutes sampling period.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: At this establishment, the employer had not established a respiratory protection program when employees were required to wear tight-fitting respirators when cutting, grinding and polishing granite and other stone s in machine work areas. An effective respiratory protection program would include, but not limited to: a. Procedures for selecting respirators for use in the work place; b. Medical evaluation of employees required to wear respirators; c. Valid fit testing procedures for each type of tight-fitting respirators; d. Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding and maintaining respirators, and; e. Training of employees in the proper use of respirators.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: At this establishment, employees engaged in manufacturing of granite and other stone countertops were exposed to hazardous chemicals, such as but not limited to, granite, marble and limestone slabs an fine particulate that contain alkali and caustics. The employer had not implemented a hazard communication program which would address labeling and other forms of warning on chemical containers, Safety Data Sheets, and employee information and training on the hazards associated with chemicals used on this site. The written program must also contain the following: 1. A list of all hazardous chemicals on site; 2. The methods the employer will use to inform employees of the hazards associated with non-routine tasks involving chemicals, such as a spill; 3. The hazards of chemicals contained in piping that is not labeled; and, 4. The method the employer will use to inform other employers (contractors) of the chemicals their employees might be exposed to while performing duties a this site.
