OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards, struck-by hazards and ejection hazards during the operation of powered industrial trucks:     (a) On or about October 05, 2018, and at times prior,  R.R.A. Corp dba Adams Lumber Co., Inc. did not ensure that employees operating forklifts such as but not limited to UniCarriers Forklifts model no. MJ1F4A40DV, serial no. J1F4-981881 were protected from crushing, struck-by and ejection hazards by ensuring the use of a restraint system (seatbelts).    Reference UniCarriers Operator's Manual, Page 22, Safety Rules and Practice states "Always make sure your seat belt is securely fastened". 29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a) On or about October 05, 2018, and at times prior,  R.R.A. Corp dba Adams Lumber Co., Inc. did not ensure that employees were competent to operate forklifts such as a UniCarriers Forklift model no. MJ1F4A40DV, serial no. J1F4-981881 in a safe manner in that forklift operators were lifting Conesco Storage System controlled employees on a forklift to adjust an installed racking system approximately 8 feet above the ground. 29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:    (a) On or about October 5, 2018, and at times prior, as a controlling employer R.R.A CORP. dba Adams Lumber Co., Inc. did not ensure that a platform made of approximately 10 to 20 sheets of plywood, 4 feet by 8 feet, was secured to the forks of a UniCarriers Forklift model no. MJ1F4A40DV, serial no. J1f4-981881 while Conesco Storage Systems, Inc. employees adjusted cantilever arms on a new racking system approximately 8 feet above the ground. An employee suffered a fall where he sustained severe injuries such as but not limited to broken ribs and broken vertebrae. MJ1F4A40DV, serial no. J1f4-981881 was erected and moved by trained employees and under the supervision and direction of a competent person.
