29 CFR 1910.106(e)(9)(iii): Combustible waste material and residues in a building or unit operating area were not kept to a minimum, stored in covered metal receptacles and disposed of daily:    a). On or about, 10/12/18, on site, for employees that use CUMBERLAND MEDIUM LACQUER THINNER 20 daily to clean the spray gun. Employees use cloth rags on a daily basis to clean spray gun. The cloth rags were observed to be in an open plastic clear trash bag. The employer did not provide a metal receptacle for employees to dispose the rags in.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):     a).    On or about 10/10/18, on site, for employees painting inside the paint booth using Rust-Oleum Beyond Acrylic  Satin Black, on a daily basis. The paint contains chemicals such as, but not limited to, Kaolin Clay, Carbon Black, Aziridine, 2-Methyl-, Dipropylene Glycol Monomethyl Ether. The SDS states that exposure may potentially cause skin and eye irritation. The employer did not implement a hazard communication program to include a written program and training.    b).    On or about 10/10/18, on site, for employees in the CAT 1 Area, occasionally using Rust-Oleum Multi Purpose Spray paint for touch ups. The spray contains chemicals such as, but not limited to Acetone, Propane, Dimethyl Carbonate, n-butane, xylenes, etc. The SDS states that exposure may potentially cause skin and eye irritation.  The employer did not implement a hazard communication program to include a written program and training.

29 CFR 1910.134(d)(1)(i): Selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability:  a). On or about 10/12/18, on site for employees using a 3M lot#A17302 dust mask when working with paints. The paper mask does not provide any protection against organic vapors from the spray paints. The employer did not provide the proper selection of respirators for the hazard presented at the site.
