29 CFR 1910.1030(c)(1)(iv)(B): The Exposure Control Plan was not reviewed and updated at least annually, whenever necessary to reflect new or modified tasks and procedures which affect occupational exposure, and to reflect new or revised employee positions with occupational exposure. The review and update of this plan was not also documented annually for consideration and implementation of appropriate commercially available and effective safer medical devices designed to eliminate or minimize occupational exposure. a) Throughout the facility, The employer did not ensure the use of newer safer medical devices such as but not limited to a retractable needle. Employees are required to use Sol Care Insulin Safety Syringe. After a resident is given an insulin shot the employee has to manually pull back the plunger for the needle to retract. Condition was noted on or about 10/10/18. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER CFR 1903.19.

NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE INSPECTION CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OF ABATEMENT FOR THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
