OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from crushing hazards:  (a) Jobsite, 289 Dales Road, Indiana, PA:  On or about October 3, 2018 structural integrity was not maintained during the erection of a garage causing it to collapse.  The walls were not adequately designed and braced to withstand the load/materials placed upon it.  The walls of the structure collapsed while an employee was positioned inside the structure.  The employee was trapped under the roof and trusses and sustained paralyzing spinal injuries.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) Jobsite, 289 Dales Road, Indiana, PA:  On or about October 3, 2018 employees were not wearing protective helmets where work was being performed overhead.  An employee was working inside a structure without wearing a hard hat and work was being performed above exposing them to potential head injury.
