OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards by table saw kick-blade: a) Sun Mountain, Inc. at 140 Commerce Road, Berthoud, Colorado: On or before October 16, 2018, the employer did not ensure employees were protected from struck-by hazards, in that the riving knife was not installed on the SawStop table saw while rabbeting. This condition exposed employees to struck-by hazards by table saw kick-back. Among other methods, a feasible and acceptable means of abatement is to read and follow the warnings listed in the owner's manual. Page 8 of the SawStop 10" Professional Cabinet Saw states "Use the riving knife for non-through sawing". Additionally, page 32 states "The riving knife should always be used whenever you need to make rabbet or other non-through cuts (where the blade does not cut through the top of the wood) and narrow cuts where the guard would interfere with the rip fence."

This conditions exposed employees to laceration and amputation hazards. b) Sun Mountain, Inc. at 140 Commerce Road, Berthoud, Colorado: On or before October 16, 2018, the employer did not ensure that the cutting head of a Delta Shaper, model 43-792 was enclosed with a cage or adjustable guard so designed as to keep the operator's hand away from the cutting edge. This condition exposed employees to laceration and amputation hazards. c) Sun Mountain, Inc. at 140 Commerce Road, Berthoud, Colorado: On or before October 16, 2018, the employer did not ensure that the cutting head of a Invicta Shaper, model 1116 was enclosed with a cage or adjustable guard so designed as to keep the operator's hand away from the cutting edge. This condition exposed employees to laceration and amputation hazards. d) Sun Mountain, Inc. at 140 Commerce Road, Berthoud, Colorado: On or before October 16, 2018, the employer did not ensure that the cutting head of a Northtech Shaper, model NT-735-10T was enclosed with a cage or adjustable guard so designed as to keep the operator's hand away from the cutting edge.
