29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:   a) Job site, 1290 Western Avenue, Pittsburgh, PA: On or about October 17, 2018, during construction activities, the employer did not ensure that employees were properly trained in trench and excavation safety. Deficiencies noted during the inspection included, but were not limited to, spoil piles were not kept at least 2 feet from the edge of the excavation.

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:   a) Job site, 1290 Western Avenue, Pittsburgh, PA: On or about October 17, 2018, during construction activities, the employer did not ensure that spoil piles were kept at least 2 feet from the edge of the excavation in that it was determined that spoil piles in several areas were located from the very edge of the excavation to under 2 feet from the edge of the excavation.
