OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and  a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to entanglement hazards:   On or about October 17, 2018, at the jobsite located at 1109 W. Diamond Road, Salina, Kansas, an employee engaged in barrier construction activities was exposed to entanglement and amputation hazards while working in close proximity to a tractor mounted, boom type, post-hole digger and auger.  The employee was exposed in that the employer had not developed and implemented a method of control which ensures employees remain at least ten (10) feet away of the moving auger.    Among other methods, a feasible and acceptable method of abatement includes:  a)  The development and implementation of administrative or engineering controls which restrict employee access to the moving auger in accordance with the manufacturer's owner's manual, the warning labels on the equipment, and OSHAs Safety and Health Information Bulletin 04-16-2008, Hazards of Auger Drilling.  b)  Obtain and/or construct a physical barrier, surrounding the perimeter of the rotating auger, to prevent employee access to the point of operation.  Physical barriers may include but are not limited to portable guardrail systems.
