29 CFR 1910.28(b)(2)(i): The employer did not ensure employees in a hoist area were protected from falling 4 feet or more to a lower level: (a) BACK MEZZANINE GATE, HA30 - Employees stored and retrieved warehouse stock, and the employees were exposed to a ten foot fall hazard created by the open gate door when the forks of the forklift were placed onto the mezzanine for loading and unloading purposes, on or about October 18, 2018. (b) BACK MEZZANINE GATE, HA50 - Employees stored and retrieved warehouse stock, and the employees were exposed to a ten foot fall hazard created by the open gate door when the forks of the forklift were placed onto the mezzanine for loading and unloading purposes, on or about October 18, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.28(b)(3)(iii): Each employee was not protected from falling into a stairway floor hole by a fixed guardrail system on all exposed sides, except at the stairway entrance: (a) W2BB BACK MEZZANINE STAIRWAY - Employees performed warehouse operations, and the guardrail around the stairway opening was not equipped with a mid-rail, on or about October 18, 2018. (b) W2BB FRONT MEZZANINE STAIRWAY - Employees performed warehouse operations, and the guardrail around the stairway opening was installed was not equipped with a mid-rail on the North side and also did not extend the full length on the East and West sides which left a 32 inch exposure to falls, on or about October 18, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

(b) BACK MEZZANINE GATE, HA50 - Employees stored and retrieved warehouse stock, and the guardrail gate was equipped with a top rail that was installed at a height of approximately 55 inches, on or about October 18, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
