29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Construction site: On or about October 22, 2018, employer did not ensure that employee applying plywood to a framed structure was provided with and required to use adequate fall protection. Employees were exposed to fall hazards from and elevation exceeding 6 feet.

29 CFR 1926.503(c)(3): When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill, the employer shall retrain the affected employee. Construction Site: On or about October 22, 2018 employee was observed engaged in framing activities without the proper use of fall protection equipment demonstrating inadequacies in the employees knowledge of fall protection. This condition exposed employee to a fall hazard of greater than 6 feet.
