29 CFR 1926.652(c)(2)(i): Design of support systems, shield systems, or other protective systems that are drawn from manufacturer's tabulated data were not in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer: a) On October 23, 2018, the protective system that an employee used for cave-in protection while working in the trench was not constructed in accordance with the manufacturer's tabulated data: 1) The struts of the shield system were used to support plywood sheets on the North and south faces of the trench. 2) The lowest strut of the shield system was installed approximately five feet above the bottom of the excavation.

29 CFR 1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet (.61m) below the bottom of the members of a support system was permitted where the system was not designed to resist the forces calculated for the full depth of the trench: a) On October 23, 2018, the shield system that was in place was not installed to provide protection against cave-in hazards from the sidewalls of the excavation, in that there was approximately two feet six inches to three feet of unprotected sidewall below the bottom of the shield and the lowest strut of the system was approximately five feet above the bottom of the excavation.
