OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from falling or collapsing wood trusses:  On October 22, 2018, employees were exposed to falls and crushing injuries while working on and in wood trusses that had not been properly braced to resist overturning and collapse, in that:  a) Top chord lateral restraint and diagonal bracing was not installed;  b) Web diagonal bracing was not installed;  c) Bottom chord lateral restraint and diagonal bracing was not installed.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   BCM Construction LLC project site located at 2311 Johnston Dr., Manitowoc, WI: On October 22, 2017, employees were exposed to fall hazards while setting trusses on a two story apartment building without fall protection while:  a) Three employees were working on and between the trusses, standing on stud walls which were >9' above the interior floor level, while trusses were being raised and secured in place;  b) Working around and near unguarded stairwell on second floor to an unguarded stairwell opening 10' above the ground floor slab;  c) Working around and near one wall opening on second floor which was not properly guarded with a standard guard rail which included a midrail;  d) Working around and near one wall opening on second floor which was not properly guarded due to a broken midrail.
