29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On October 22, 2018, located at 9063 S. State Route 201, employees performing flagging operation were exposed to struck-by hazards by vehicular traffic during a Temporary Traffic Control Zone. The employees had not been instructed by the employer in recognition and avoidance of unsafe conditions to control or eliminate any hazards associated with flagging operations. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
