29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a. On or about October 24, 2018, at the above addressed jobsite, an employee was performing fiber optic boring in the west trench, measured at five (5) feet five (5) inches in depth, without cave-in protection. The competent person did not ensure the necessary precautions were taken to protect the employees from cave-ins, thereby exposing employees to the hazards associated with cave-ins.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a. On or about October 24, 2018, at the above addressed jobsite, an employee was performing fiber optic boring operations in the west trench measured at five (5) feet five (5) inches in depth. The trench was not provided with cave in protection, thereby exposing the employee to cave in hazards. Archon Construction Co., Inc. was previously cited for a violation of this Occupational Safety and Health Standard 1926.652(a)(1), which was contained in OSHA inspection number 1147248, citation number 1, item number 1 and was affirmed as a final order on June 14, 2016, with respect to a workplace located at 13233 S. Cicero Avenue, Crestwood, IL 60445.
