On or about October 23, 2018, at the above addressed jobsite, an inspection was performed by a competent person and the competent person failed to remove the employees from the hazard(s) and/ or correct the hazardous condition(s).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a. On or about October 23, 2018, at the above addressed jobsite, employees were conducting water operations in a trench measured at seven (7') feet, eight (8") inches in depth. The trench was not provided with cave in protection, thereby exposing the employees to cave in hazards.
