29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles. The employer is failing to ensure that the eyes and face of employees are protected from flying particles while working on a residential roof. This most recently occurred on October 23, 2018 on the jobsite located at 2150 Broadwater Dr., Omaha, NE 68046. The company owner and one employee were observed using hand-held pneumatic nail guns to install roofing material without any form of eye or face protection.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: The employer is failing to ensure that all employees exposed to fall hazards while working on a residential roof are utilizing fall protection. This most recently occurred on October 23, 2018 on the jobsite located at 2150 Broadwater Dr., Omaha, NE 68046. Five employees were re-roofing a two-story residential house and not utilizing any form of fall protection. The house has an eight in twelve steep sloped pitch and ground to eve height is approximately eleven to twenty-three feet depending on which level they were working on.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: The employer is failing to ensure that all employees are protected from fall hazards when entering and exiting the landing surface of a residential roof. This most recently occurred on October 23, 2018 on the jobsite located at 2150 Broadwater Dr., Omaha, NE 68046. The owner and five employees are using a fiberglass extension ladder to enter and exit the roof where the side rails were not extended to at least 3 feet above the landing surface which is about twenty-one feet above the ground.
