29 CFR 1926.453(a)(2): Aerial lifts may be "field modified" for uses other than those intended by the manufacturer provided the modification has been certified in writing by the manufacturer or by any other equivalent entity, such as a nationally recognized testing laboratory, to be in conformity with all applicable provisions of ANSI A92.2-1969 and this section and to be at least as safe as the equipment was before modification.  On or about October 25, 2018, employees were exposed to a fall of approximately 12 feet while performing framing activities on a new residential home located on SL 114 Atlantic Ave., North Ridgeville, Ohio 44039.  One employee was being lifted to upper levels on a JLG forklift and the employer did not ensure that the modified platform was being used as the manufacturer intended.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  On or about October 25, 2018, employees were exposed to a fall of approximately 12 feet while performing framing activities on a new residential home located on SL 114 Atlantic Ave., North Ridgeville, Ohio 44039.  One employee was working on the first level of the roof and the employer did not ensure that he was using fall protection.
