29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees;  On or about 10/24/2018,  Location: Old pavers driveway entrance of residential renovation under construction:  1) Employees were exposed to being struck by flying objects while removing driveway pavers from concrete not required to use protective helmets or eye protection. The three employees were working in an active construction site, in close proximity to other subcontractors working at the jobsite doing activities such as but not limited to excavations, masonry, concrete, etc.

Detachable side protectors (e.g. clip-on or slide-on side shields) meeting the pertinent requirements of this section are acceptable;  On or about 10/23/2018,  Location: Old pavers driveway entrance of residential renovation under construction;  1) Employees were exposed to being struck by falling or flying objects while working in a residential renovation construction removing driveway pavers not provided with eye protection.
