29 CFR 1910.178(p)(1): Powered industrial trucks found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating conditions. Employees operating fork trucks and employees working in the surrounding areas of the warehouse were exposed to struck by hazards in that fork trucks that were in need of repair were not taken out of service in the following instances: a) 2 fork lifts were not equipped with seat belts b) The propane powered Yale fork lift was missing pin locks c) 2 fork lifts were missing a sounding horn.
