29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:      On or about October 01, 2018, trench safety training was not provided to employees tasked with connecting a 6 inch drain pipe into a catch basin of a sewer storm drainage system located at 4087 Rocky River Dr. in Cleveland, OH. Employees were not trained to identify soil type and/or hazards such as; but not limited to, sloughing and fissures or to recognize that the vibration from heavy earth-moving equipment or motor vehicles could result in excavated materials (the spoil pile) falling back into the trench.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.       On or about October 01, 2018, the employer failed to ensure that employees in the process of connecting a 6 inch drain pipe into a catch basin of a sewer storm drainage system located at 4087 Rocky River Dr. in Cleveland, OH, were protected from excavated materials (the spoil pile) falling back into the trench by placing the material at least 2 feet from around the edge of the trench or by the use of a retaining device.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).     On or about October 01, 2018, while in the process of connecting a 6 inch drain pipe into a catch basin of a sewer storm drainage system located at 4087 Rocky River Dr. in Cleveland, OH, the employer did not ensure employees working inside a trench at a depth of approximately 5 (+) feet were protected from cave-ins by an adequately designed protection system.
