OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to serious injuries or death from falling while working from the basket of an aerial lift:    Jobsite: The employer did not ensure that pertinent parts, including internal cables of the Terex Telelect 6H Serious articulating aerial lift (aerial lift) were not only inspected, serviced, but also replaced as often as necessary per manufacturer's recommendations.      On or about October 29, 2018, an internal cable functioning to keep the basket of the aerial lift on level broke while an employee was trimming a tree from the basket, and the basket fell forward causing the employee to fall from the basket onto a metal platform. The employee sustained injuries from the incident.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and regulated.    Worksite: The employer did not ensure that the employee trimming a tree from the basket of an aerial lift was not only wearing, but also attached to the basket or boom with an appropriate type of personal restraint system/device.    On or about October 29, 2018, the basket fell forward while the employee was performing the tasks, causing the employee to fall from the basket onto a metal platform. The employee sustained injuries from the incident.
