29 CFR 1910.151(b): In the absence of an infirmary, clinic, or hospital in near proximity to the workplace which is used for the treatment of all injured employees, persons were not adequately trained to render first aid:    (a)Stretch's Well Service, Inc. at 16266 366th Avenue, Cresbard, SD 57435:  On or about and at times prior to October 30, 2018, the employer did not ensure employees were provided adequate training to render first aid. The water drilling crew worked in a remote location and were not near a clinic or hospital and were not provided adequate training to provide first aid. The employer did not create procedures in the form of a site-specific emergency action plan to assist employees in the event of an emergency situation that would outline rescue and medical duties for those employees who are to perform them. This condition exposed employees to not receiving prompt medical attention.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    (a)Stretch's Well Service, Inc. at 16266 366th Avenue, Cresbard, SD 57435:  On or about and at times prior to November 1, 2018, the employer did not ensure that the workplace was assessed to determine if hazards were present, which would necessitate the use of personal protective equipment. Employees were exposed to, but are not limited to hazards such as; lacerations, puncture wounds, and eye injuries. Employees operate the George E. Failing drill rig and utilize other tools and equipment without the use of personal protective equipment. This condition exposed employees to struck-by and eye hazards associated with these tools and equipment.      Abatement Note: The employer shall verify that the required workplace hazard assessment has been performed through a written certification that shall include the following:      (1)  The workplace evaluated;  (2)  The person certifying that the evaluation had been performed;  (3)  The date(s) of the hazard assessment; and,  (4)  The document identified as a certification of the hazard assessment.

29 CFR 1910.140(c)(13)(i): Anchorages except window cleaners' belt anchors covered by paragraph (e) of this section, was not capable of supporting at least 5,000 pounds (22.2 kN) for each employee attached; or (c)(3)(ii) was not designed, installed, and used under the supervision of qualified person, as part of a complete personal fall protection system that maintains a safety factor of at least two:    (a)Stretch's Well Service, Inc. at 16266 366th Avenue, Cresbard, SD 57435: On or about and at times prior to November 1, 2018, the employer did not evaluate the anchorage point on the upper working surface of a water well drilling rig. Employees were working on a thirty-foot high work platform on the derrick of the George E. Failing drilling rig utilizing a fall protection system anchored to a tubular-welded top rail. The railing had not been evaluated to ensure adequate support in the event of a free fall. This condition exposed employees to a fall hazard of approximately 30 feet if the anchorage point were to fail.

29 CFR 1910.140(d)(2)(ii): Personal fall arrest systems are rigged in such a manner that the employee cannot free fall more than 6 feet (1.8 m) or contact a lower level.  A free fall may be more than 6 feet (1.8 m) provided the employer can demonstrate the manufacturer designed the system to allow a free fall of more than 6 feet and tested the system to ensure a maximum arresting force of 1,800 pounds (8 kN) is not exceeded:    (a)Stretch's Well Service, Inc. at 16266 366th Avenue, Cresbard, SD 57435:  On or about and at times prior to November 1, 2018, the employer did not ensure that the fall protection system in use was rigged in such a manner that would not allow the employee to be exposed to a free fall greater than six feet.  The fall protection system consisted of a DBI Sala Force 2 shock absorbing six-foot lanyard connected to a rope-grab device on a 52 inch rope with a pelican hook. This condition allowed for a free-fall greater than 6-foot.

29 CFR 1910.30(a)(1):  The employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before any employee is exposed to a fall hazard.  Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017.  (a)Stretch's Well Service, Inc. at 16266 366th Avenue, Cresbard, SD 57435:  On or about and at times prior to November 1, 2018, the employer did not provide fall protection training to employees who are required to access the upper work platform on the derrick of the George E. Failing drilling rig. Employees use a full body harness and a single lanyard with a pelican hook to climb the derrick to reach the platform approximately 30 feet high. This condition exposed employees to fall hazards up to 30 feet.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    (a)Stretch's Well Service, Inc. at 16266 366th Avenue, Cresbard, SD 57435: On or about and at times prior to October 30, 2018, the employer did not ensure that rotating parts associated with the "Quill/Kelly" located on the George E. Failing water well drilling rig were effectively guarded.  As a result of two bolts projecting 2.5 inches horizontally from the rotating Kelly, an employee was seriously injured after being caught-by the powered rotating equipment. This condition exposed the employees to struck-by and caught-by hazards.
