29 CFR 1910.132(d)(1)(i): The employer did not select and have each affected employee use, the types of personal protective equipment that would protect the affected employee(s) from the hazards identified in the hazard assessment: Battery Section, 15190 Veteran Memorial Pkwy, Wentzville: Employer is exposing employees to hazardous conditions. The employer permits employees to handle leaking batteries without a protective apron to prevent acid contact with employees' street clothing. Employees were exposed to injurious acid from leaking batteries for approximately three weeks without being provided appropriate personal protective equipment. Some employees sustained acid burns.

The employees are permitted to handle leaking batteries where they are exposed to injurious corrosive battery acid without facilities for flushing of the eyes within the work area. On 10/31/2018 employees were observed handling lead batteries without any quick drenching and eye flushing facilities in the work area.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe were not taken out of service until they were restored to safe operating conditions: 15190 Veteran Memorial Pkwy, Wentzville, MO: Employer is exposing employees to hazardous conditions. The employees are permitted to operate forklifts with defects. On 10/31/2018 two employees were observed operating forklifts with the following defects: Receiving area:- damaged right rear tire, brake pedal missing slip resistant pad, and broken non-working signal lights on REAL LIFT forklift (Model RW 26Y, S/N-100206751); Outside area:- damaged right side lamp and signal lights assemblies on UTILEV (Model UT25P, A285 J02621L). The employer, Rural King, was previously cited for a repeated violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910. 178 (p) (01), which was contained in OSHA inspection number 956776, citation number 01, item number 01 and was affirmed as a final order on 01/09/2015, with respect to a workplace located at 67501 Mall Ring Road, Saint Clairsville, OH 43950
