29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  (a) The employer failed to certify that Citation 1, Item 1, issued on 1/14/2019 with an abatement date of 02/08/2019 had been abated.  (b) The employer failed to certify that Citation 2, Item 2, issued on 1/14/2019 with an abatement date of 02/08/2019 had been abated.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles.  The employer is failing to ensure that the eyes and faces of employees are protected from flying particles while working on a residential roof. This was most recently documented on October 31, 2018 on the jobsite located at 17712 Castelar Circle, Omaha, Nebraska 68130. Three employees were observed using hand-held pneumatic nail guns to install roofing material without any form of eye or face protection.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system.  Employees are not protected from fall hazards while working on a residential roof. This was most recently documented on October 31, 2018 on the jobsite located at 17712 Castelar Circle, Omaha, Nebraska 68130. Four employees were observed on the roof of a single-story house with 6 in 12 steep sloped pitches at heights at least 11 feet and 3 inches above the ground. None of the employees were using any form of fall protection.   Veliz Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which is contained in OSHA inspection number 1269743, Citation #1, Item #1, and was affirmed as final order on December 15, 2017.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  Employees exposed to fall hazards are not effectively trained on fall hazard recognition and how to use fall protection. This was most recently documented on October 31, 2018 on the jobsite located at 17712 Castelar Circle, Omaha, Nebraska  68130. The employer has four employees who have received inadequate fall protection training and are exposed to fall hazards while installing underlayment to the roof of the house in preparation for shingles. None of the employees were utilizing any type of fall protection. The roof has 6 in 12 pitches, and ground to eave height is 11 feet 3 inches.  Veliz Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.503(a)(1), which is contained in OSHA inspection number 1269743, Citation #1, Item #2, and was affirmed as final order on December 15, 2017.
