29 CFR 1910.95(g)(6): At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels :    a. On or about November 6, 2018, at 7860 NW 66th St. Miami, FL 33166 bindery department, an employee operating a folding machine was exposed to a noise level of 87.2 dBA, which exceeds the 85.0 dBA during the 8-hr representative sampling period. The employer failed to provide the employee with an annual audiogram after the employees' first baseline.    b. On or about November 6, 2018, at 7860 NW 66th St. Miami, FL 33166 press department, an employee operating as a second press operator was exposed to a noise level of 90.7 dBA, which exceeds the 85.0 dBA during the 8-hr representative sampling period. The employer failed to provide the employee with an annual audiogram after the employees' first baseline.    c. On or about November 6, 2018, at 7860 NW 66th St. Miami, FL 33166 bindery department, an employee operating a die-cutter machine was exposed to a noise level of 91.0 dBA, which exceeds the 85.0 dBA during the 8-hr representative sampling period. The employer failed to provide the employee with an annual audiogram after the employees' first baseline.    d. On or about November 6, 2018, at 7860 NW 66th St. Miami, FL 33166 baler department, an employee operating a baler machine was exposed to a noise level of 93.3 dBA, which exceeds the 85.0 dBA during the 8-hr representative sampling period. The employer failed to provide the employee with an annual audiogram after the employees' first baseline.

29 CFR 1910.95(i)(5): The employer did not ensure proper initial fitting and supervise the correct use of all hearing protectors:  On or about October 31, 2018, at 7860 NW 66th St. Miami, FL 33166 bindery department, an employee assisting the folding machine operator was exposed to a noise level of 87.2 dBA, which exceeds the action level of 85.0 dBA, during the 8-hr representative sampling period. The employer failed to ensure the assistant working alongside this employee was wearing hearing protection properly.
