29 CFR 1926.1203(a): Before beginning work, the employer did not identify all confined spaces in which employees may work, and did not identify each space that is a permit space, through consideration and evaluation of the elements of that space, including testing as necessary.     a) On or about October 29, 2018 at 2001 Riverside Drive, Gainesville, Georgia, , the employer allowed employees to enter a utilities manhole to determine the location of conduits without evaluating the space to determine if the manhole was a permit required confined space by atmosphere testing and/or other means as necessary.

29 CFR 1926.1203(d): If any employer decides that employees it directs will enter a permit space, that employer must have a written permit space program that complies with �1926.1204 implemented at the construction site. The written program must be made available prior to and during entry operations for inspection by employees and their authorized representatives.   a) On or about October 29, 2018 at 2001 Riverside Drive, Gainesville, Georgia, an employee was directed to enter into a utilities manhole to determine if the conduit in the manhole serviced the Curtis Building where repairs to a data conduit were being made.  The employer did not document or implement a written permit space program as required.

The employer failed to call to locate utilities prior to digging.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:     a) On or about October 25, 2018 through October 29, 2018 at Curtis Hall, 2001 Riverside Drive, Gainesville, Georgia during the excavation to locate a data line that was buried next the Curtis Hall, workers were lowered into to the trench in the bucket of a backhoe.  The employer failed to provide a safe means of access/egress in a trench that was approximately 9 feet deep and 3 feet wide.
