29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about November 2, 2018, at the above addressed jobsite, employees using pneumatic nail guns did not wear safety glasses, thereby exposing the employees to the hazards associated with eye injuries.  Art's and May's Construction, Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.102 (a)(1) which was contained in OSHA inspection number 1220878, citation number 1, item number 1 and was affirmed as a final order on April 27, 2017, with respect to a workplace located at 1127 Kenton Road, Deerfield, IL 60015.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a.  On or about November 2, 2018 at the above addressed jobsite, employees conducting roofing operations, twenty (20) feet above the ground, were not protected from falling.  Art's and May's Construction, Inc. was previously cited for a violation of an equivalent 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1221450, citation number 1, item number 1 and was affirmed as a final order on May 4, 2017, with respect to a workplace located at 24402 State Line Road, Crete, IL 60417.  Art's and May's Construction, Inc. was previously cited for a violation of an equivalent 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1220878, citation number 1, item number 2 and was affirmed as a final order on April 27, 2017, with respect to a workplace located at 1127 Kenton Road, Deerfield, IL 60015.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a. On or about November 2, 2018, at the above addressed jobsite, the portable ladder used to access the roof did not extend at least three (3') feet above the upper landing surface, thereby exposing employees to the hazards associated with falls.   Art's and May's Construction, Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.1053(b)(1) which was contained in OSHA inspection number 1220878, citation number 1, item number 3 and was affirmed as a final order on April 27, 2017, with respect to a workplace located at 1127 Kenton Road, Deerfield, IL 60015.
