29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems was not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. On 11/2/2018, employees of Rite-A-Way Lawn Care LLC were repairing an irrigation water pipe located at the intersection of Meadow Circle Drive and Fountain Grass Drive, Lake Saint Louis, MO 63367. The employer did not have a competent person perform an inspection of the excavation and surrounding areas to identify any potential hazards before employees entered the 4 foot, 11 inch deep excavation to perform work on the irrigation water pipe.
