29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:  On or about November 2, 2018, and at times prior thereto, the employer did not ensure the truck was marked to identify the difference in the weight limits with the attachment installed. Employees use the attachment to pull plates out of cement forms. The attachment is installed on the Hyster H280XL forklift. Employees are exposed to hazard of being struck-by a shifting load or an unbalance forklift tipping.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:   On or about November 2, 2018, and times prior thereto, the employer failed to ensure that the forklift training consisted of combination of formal instruction and practical training. Employees operate the forklifts in the yard and are transporting cement forms. Employees were exposed to the hazard of being struck-by a forklift and/or a load falling off.

29 CFR 1910.28(b)(3)(ii): Each employee was not protected from tripping into or stepping into or through any hole that was less than 4 feet (1.2 m) above a lower level by covers or guardrail systems:  On or about November 2, 2018, employees were exposed to a fall hazard. Employees must work near a cutout/opening in the walking working surface which is approximately 20 to 24 inches deep. Employees will hammer off plates from the cement forms in this area. The employees will work between the concrete forms and the cutout/opening in the pavement. They are working with their backs to the cutout and could easily lose their balance and fall. Employees are exposed to the hazard of falling into the cutout/opening in the pavement.   Comal Concrete Products Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1910.28(b)(3)(ii) which was contained in OSHA inspection number 1252317, citation number 1, item number 1 and was affirmed as a final order on September 4, 2017, with respect to a workplace located at 4222 FM 482, New Braunfels TX, 78132.
