29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup, or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    (a)  In the ice bins, on or about November 2, 2018, and at times prior to, the employer did not establish a lockout program consisting of an energy control procedure for equipment such as, but not limited to the rake, exposing employees to hazards associated with energizing, startup, or release of stored energy.

29 CFR 1910.303(c)(3)(i): All splices and joints and the free ends of the conductors were not covered with an insulation equivalent to that of the conductors or with an insulating device identified for the purpose.      (a)  Inside the ice bins on the rake system motor, on or about November 2, 2018, and at times prior to, the wiring powering the rake motor had been spliced and was exposed in a wet environment, exposing employees to electrical shock hazards.

29 CFR 1910.303(g)(2)(i): Except as elsewhere required or permitted by Subpart S of Part 1910, live parts of electric equipment operating  at 50 volts or more were not guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the means identified in paragraphs (A), (B), (C), and (D) of 29 CFR 1910.303(g)(2)(i):    (a)  At the main panel box for the ice bin/rake system, on or about November 2, 2018, and at times prior to, the high voltage panel box cover was left in an open position, exposing employees to arching and electrical shock hazards.

(a)  In the process area and facility yard, on or about November 2, 2018, and at times prior to, the employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely by training and evaluation.
