29 CFR 1926.20(b)(2): It shall be the responsibility of the employer to initiate and maintain programs which provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On or about August 20, 2018 at 1015 N Broadway Street in De Pere, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized the fall from elevation hazards associated with employees working on a roof surface and accessing/egressing a roof surface through a second floor window opening.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) On or about August 20, 2018 at 1015 N Broadway Street in De Pere, employees were working on a roof surface thirteen feet above surface level without utilizing fall protection equipment. b) On or about August 20, 2018 at 1015 N Broadway Street in De Pere, employees were accessing/egressing a roof surface through a second floor window opening eleven feet above surface level without utilizing fall protection equipment.
